The live auction will be conducted Sunday, August 15 at 4:00 PM Eastern. All bidding will conclude Sunday, August 15 when no more bids from live or online bidders are made. The Auctioneer, Broker, Wardlow Auctions, Inc., Seller, and the internet and software providers do not guarantee or warrant the online bidding procedure and/or system to operate without interruption or malfunction. Live Registration: Bidders may register for the live auction at 809 Smith View Ct., Louisville, KY 40214 on auction day beginning at 2:00 PM. A valid driver’s license is required for registration. Bidders at the live auction will be denoted as “floor” for their bidder number on the online bidding website. Online Registration: As with the live auction, bidders must be registered with a full name, address, and telephone number. An email address is also required so bidders may be sent winning bid notifications and auction invoices. Information from either a MasterCard or Visa is to be held on file. This information is obtained to deter defunct bidding. Registration may only be completed with an acknowledgment that the bidder has read and understood all terms and conditions for the sale and online bidding. Each registered bidder will be assigned a permanent number to be used on all online auctions. These numbers will not be applicable at any live auction since we use a different database for that information. By placing an online bid, the Bidder hereby agrees to be bound by these Online Terms & Conditions. The high bidder agrees to be legally bound to their winning bid. The high bidder agrees to fulfill their obligations in regards to remitting required sufficient funds in the specified time frame and a signed Real Estate Purchase Contract. Notification of the winning bid to an online bidder will be made as soon as possible after the auction’s close. Online bids can be made using two methods: “Your Bid” and “Your Maximum.” Buyer’s Premium: A 10% buyer’s premium will be added to all winning bids to determine the final contract selling price. For example, if the closing bid is $150,000, the Buyer’s Premium would be $15,000 resulting in a final contract selling price of $165,000. Bidding Increments: Online bids must be in multiples of $500 (i.e. $500, $1,000, $1,500, $2,000, etc.). The minimum online bid increment for this auction is $500. Close of Bidding: All bidding will close when no additional live or online bids are made as of the live auction beginning Sunday, August 15, at 4:00 PM. Bids from the online and live bidders will be kept updated up to the end of the auction. *Please note that with any live auction we do, the first 15-20 minutes of the auction involves the auctioneer highlighting the property features, making announcements and explaining to the live bidders the terms and conditions before the live bidding actually begins. Title Examination: A title examination was completed effective July 2010. The examination reported that there are no mortgages of record and that all tax bills issued prior to the year 2010 are paid. Contract Execution: At the close of the auction, a Real Estate Purchase Contract must be signed. If the successful bidder is at the live auction, this contract will be signed immediately following the auction. If the successful bidder is online, they will be emailed, faxed, or delivered a contract to be executed and returned to Wardlow Auctions, Inc. The executed contract must be returned within 24 hours by personal delivery, email or fax to Wardlow Auctions, Inc. A copy of this contract will be available for your review at the open house or click the following link for the 809 Smith View Ct. Auction Purchase Contract. Down Payment: The Buyer shall make a non-refundable down payment of $10,000.00. The down payment may be in the form of cash, a official bank check, certified check, good personal check or wire transfer. If the successful bidder is at the live auction, the down payment is due immediately following the auction. If the successful bidder is online, the down payment must be received in full by 5:00 PM EDT Monday, August 16, 2010. Closing: Balance of purchase price due at closing on or before September 29, 2010. The Auctioneer reserves the right to reject the bidding of anyone whose conduct, actions, or comments are not in the best interest of the Seller, anyone who, in the Auctioneer’s judgment, lacks the capacity to enter into a contract or to close or anyone who makes online bids that appear to be erroneous or fraudulent.
